Kui Eesti Vabariik 20. augustil 1991 oma iseseisvuse taastas, moodustas Eesti Vabariigi Ülemnõukogu uue põhiseaduse koostamiseks 60-liikmelise Põhiseaduse Assamblee, kuhu kuulus võrdne arv ülemnõukogu ja Eesti Kongressi saadikuid. Põhiseaduse Assamblee töötas uue põhiseaduse välja 1938. aastal jõustunud põhiseaduse alusel. Põhiseadus võeti vastu rahvahääletusel 28. juunil 1992 ning jõustus 3. juulil 1992. Põhiseadus lähtub Eesti Vabariigi õiguslikust järjepidevusest alates selle väljakuulutamisest 24. veebruaril 1918. Eesti on põhiseaduse järgi iseseisev ja sõltumatu demokraatlik vabariik, kus kõrgeima riigivõimu kandja on rahvas.
When the Republic of Estonia re-established its independence on 20 August 1991, the Supreme Council of the Republic of Estonia set up a 60-member Constitutional Assembly to write a new constitution, with an equal number of members drawn from the Supreme Council and the Congress of Estonia, an alternative representation of the people. The Constitutional Assembly worked out the Constitution of the basis of the Constitution of 1938; it was adopted by a referendum on 28 June 1992 and entered into force on 3 July 1992. The Constitution proceeds from the legal continuity of the Republic of Estonia since its proclamation on 24 February 1918. According to the Constitution, Estonia is an independent and sovereign democratic republic wherein the supreme power of state is vested in the people.
